these terms are the agreement between you and The House of Maria for using maria. please read them. by signing in and using maria, you agree to them. if you do not agree, please do not use maria.

who can use maria

maria is for adults. you must be 18 or older, and able to enter a binding agreement, to use her. maria is currently offered in the united states.

what maria is, and what she is not

this is the most important part of these terms, so we have put it first.

maria is an ai companion for women's health. she is here to listen, hold your context over time, help you understand what is happening in your body, and help you prepare for and follow up on your own care. maria is not a doctor, nurse, midwife, therapist, or any kind of licensed professional, and she is not a substitute for one. she does not diagnose, treat, or prescribe. anything she offers is information and support, not medical advice.

maria is not an emergency service. if you are having a medical or mental health emergency, do not wait for maria. call 911, or in the united states call or text 988 for a mental health crisis. always seek the advice of a qualified professional with any question about your health, and never disregard or delay professional advice because of something maria said.

the service

maria is early. right now she is offered as a trial to a small number of people, and she is provided as she is, with features that will change, appear, and sometimes break as we build. we do not promise she will always be available, or that everything she tells you will be complete or correct. you understand you are using an early product and you use your own judgment alongside her.

your account

you reach maria through whatsapp and sign in with the details you provide. keep your account and the device it lives on secure, since anyone with access to them can see your conversations with maria. the activity under your account is your responsibility. tell us promptly if you think someone else has gained access.

acceptable use

when you use maria, you agree not to:

• use her for anyone's information other than your own, unless you have that person's clear permission
• use her for anything unlawful, or to harm someone else
• try to break, overload, probe, or get around the security of the service
• treat her as a doctor or as an emergency line, which she is not

connected services

if you connect google or oura, or use maria over whatsapp, those services are run by other companies under their own terms and privacy practices, and connecting them is your choice. you can disconnect them at any time. we are responsible for what we do with the data you connect, as described in our privacy policy, not for how those companies run their own services.

your content and ours

what you share with maria, your messages, logs, and documents, stays yours. by using maria, you give us permission to process that content for the one purpose of running the service for you, in the ways our privacy policy describes. maria herself, the software, her voice, and the material we create belong to The House of Maria, and using the service does not transfer any of that to you.

privacy

how we handle your information is set out in our privacy policy, which is part of these terms. please read it, since it explains what maria collects, who processes it, and how to delete it.

disclaimers

maria is provided "as is" and "as available," without warranties of any kind, whether express or implied. we do not warrant that maria will be uninterrupted, error-free, or secure, or that any information she provides is accurate, complete, or suitable for your situation. any health-related information maria offers is general and is not a clinical judgment about you.

limitation of liability

to the fullest extent the law allows, The House of Maria will not be liable for any indirect, incidental, special, or consequential damages, or for any loss arising from your use of or reliance on maria, including any health decision made in connection with her. nothing in these terms limits liability that cannot be limited by law.

ending your use

you can stop using maria at any time, and ask us to delete your data as described in the privacy policy. we may suspend or end access to the service, for example if it is misused or if we stop offering it, and we will try to give you reasonable notice when we can.

changes to these terms

as maria develops, these terms will change. when they do, we will update the date at the top, and for material changes we will let you know rather than changing them quietly. continuing to use maria after a change means you accept the updated terms.

governing law

these terms are governed by the laws of the state of delaware, united states, without regard to its conflict-of-laws rules.
